Fees

Daily rate for hearings (All Courts)

Interim hearings completed before 1.00 pm

Conferences (up to 60 min) including reading of brief, then charged as below

Hourly rate for reading documents, preparation, conferences, drafting and settling of documents, telephone attendances(charged in units of 6 minutes)

Terms of Engagement

Fees in trust required

1.           My appearance is subject to payment not less than seven (7) days before the hearing into your trust account sufficient funds to cover my estimate of fees likely to be incurred unless other arrangements are confirmed in writing.  This applies particularly to hearings where the subject matter relates to parenting or other non financial matters.  Special arrangements may on occasion be made in property cases for payment of fees to be deferred but this will only apply if I specifically confirm it in writing.

Reservation of dates

2.           I will not reserve a hearing date until a brief is delivered and satisfactory arrangements for payment of my fees are confirmed. 

Terms of Payment

3.            Payment of fees is required within 30 days of a fee note being rendered unless otherwise agreed in writing.  Fees shall remain payable even in the event the client terminates instructions or discontinues the proceedings for any reason. In the event fees are not paid within this period, that portion remaining unpaid shall attract interest at the rate prescribed under the Family Law Rules 2004 calculated on a daily basis from the 30th day until date of payment.

Cancellation Fees

4.            Once my dates have been reserved and in the event the matter is settled before the hearing date or I am otherwise not required to appear, my cancellation fees (unless otherwise agreed in writing) are:

Notice received not less than 14 days before hearing

 

no charge

Notice received not less than 7 days before hearing

 

50% brief fee

Notice received less than 7 days before hearing

 

100% brief fee

Direct briefs

5.            I will not act directly for clients without an instructing solicitor under any circumstances.

Responsibility for payment of fees

6.            Please note that in accordance with the Legal Profession Act (2004)  the Solicitors’ obligations are personal and do not depend on their being put in funds by the client.

Urgent Work

7.            I am required to provide a costs disclosure and fee agreement and normally will do so.  However, if I am engaged at short notice and time does not otherwise permit you should advise your client of my terms of engagement as set out herein. I will endeavor to provide a written costs disclosure and fee agreement as soon as practicable thereafter.
